Digital Inclusion for All…

The internet provides us with a wealth of information, a great form of communication as well as discounts on everything from a weekly shop to booking  a holiday. It is something many of us take for granted but there are over 6 million adults in the UK who have never used the internet and are therefore not just digitally excluded but socially excluded? Thankfully this number is gradually being reduced by classes at colleges, libraries and UK online centres.

So what does A Helping Hand offer?

We provide specialist one to one home tuition specifically aimed at helping people over the age of 50 (Silver Surfers). We recognise that there are many different ways of learning and while some people benefit from being taught in groups, others prefer learning individually and at their own pace. Our aim is to enable our clients to find their way around a computer and use the internet in a proven easy to follow way, minus the jargon!

Age and experience shouldn’t be barrier in getting online which is why we are working with Age UK on their Digital Inclusion Campaign and are an Official Partner of Race Online 2012 whose ambition is making the UK the first nation in the world where everyone can use the web.

A Helping Hand -Terms and Conditions

1.Terms of Sale

Please read these terms of sale carefully.

Interpretation

1.1 In these terms of sale, "we" means A Helping hand and "us" and "our" will be construed accordingly); and "you" means our customer or potential customer for products (and "your" will be construed accordingly).

1.2 Order process

The advertising of products on our website constitutes an "invitation to treat"; and your order for products constitutes a contractual offer.  No contract will come into force between you and us unless and until we accept your order in accordance with the procedure detailed below.

1.3 In order to enter into a contract to purchase products from us, you will need to take the following steps:"(i) you must add the products you wish to purchase to your shopping cart, and then proceed to the checkout; (ii) if you are a new customer, you must then create an account with us and log in; if you are an existing customer, you must enter your login details; (iii) once you are logged in, you must select your preferred method of delivery and confirm your order and your consent to these terms of sale; (iv) you will be transferred to the PayPal website, and PayPal will handle your payment; (v) we will then send you an initial acknowledgement; and (vi) once we have checked whether we are able to meet your order, we will either send you an order confirmation (at which point your order will become a binding contract) or we will confirm by email that we are unable to meet your order."

1.4 We will not file a copy of these terms of sale specifically in relation to your order.  We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible.  We therefore recommend that you download, print and retain a copy of these terms of sale for your records.

1.5 The only language in which we provide these terms of sale is English.

1.6 Before you place your order, you will have the opportunity of identifying whether you have made any input errors by. You may correct those input errors before placing your order.

The products

2. A Helping Hand Gift Vouchers

Price and payment

2.1 Prices for products are quoted on our website.  The website contains a number of products and it is always possible that some of the prices on the website may be incorrect.  We will verify prices as part of our sale procedures so that a product's correct price will be stated when you pay for the product.

2.2 In addition to the price of the products, you may have to pay a delivery charge, which will be as stated when you pay for the product.

2.3 Payment must be made upon the submission of your order  We may withhold the products and/or cancel the contract between us if the price is not received from you in full in cleared funds.

2.4 The prices on the website include all value added taxes (where applicable).

2.5 Payment for all products must be made by Paypal via a debit/credit card or via an instant bank transfer through Paypal.

2.6 Prices for products are liable to change at any time, but changes will not affect contracts which have come into force.

Despatch

2.7 We will despatch Vouchers upon receipt of cleared funds in respect of the Vouchers.  While we do keep a stock of Vouchers at all times, if we receive a number of large orders at or around the same time, that may delay delivery of your order as we will need to have more Vouchers printed.

2.8 We aim to dispatch your Gift Vouchers within 2 working days both for Standard Royal Mail Special Delivery Orders.

Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Discrepancies 1. If you receive Vouchers and there are any discrepancies in the number of Vouchers delivered as against your order, you must notify us within 7 days of receiving the Vouchers otherwise you are deemed to have accepted the order as correct.

Terms Governing the Vouchers

You may not sell the Vouchers to any third parties without our consent. If we do give our consent then such consent may be subject to any conditions which we impose. In any event you may not sell the Vouchers through the internet without our express written consent, which you must obtain before making any such sale. We reserve the right at all times to refuse to permit any sale of Vouchers by you to a third party. You may change your order if we have not yet despatched the Vouchers. However once we have despatched the Vouchers you may not change the order. If you do make a change to your order this may result in a delay in despatch.
a. A Helping Hand gift vouchers are valid for 12 calendar months less one day from the date you have ordered the gift voucher(s).
b. Gift vouchers may not be exchanged for cash. Promotional discounts Coupons, discounts and promotional discount codes offered by ahelpinghand.co.uk are valid only for use as part of a purchase made via ahelpinghand.co.uk, unless otherwise stated.
c. The Gift Vouchers can be used at any London, Kent and Surrey Postal Code.

Statutory rights

Nothing in these terms of sale affects your statutory rights (including your right to receive a refund in respect of any defective product we sell to you).

Limitations and exclusions of liability.

Nothing in the terms of sale will: (a) limit or exclude the liability of a party for death or personal injury resulting from negligence; (b) limit or exclude the liability of a party for fraud or fraudulent misrepresentation by that party; (c) limit or exclude any liability of a party under Section 12, 13, 14 or 15 of the Sale of Goods Act 1979 or Part I of the Consumer Protection Act 1987; (d) limit any liability of a party in any way that is not permitted under applicable law; or (e) exclude any liability of a party that may not be excluded under applicable law.  Any statutory rights which you have as a consumer, which cannot be excluded or limited, will not be affected by the terms of sale.

We will treat all your personal information that we collect in connection with your order in accordance with the terms of our privacy policy; use of our website will be subject to our website terms of use.

3. Our Services (Technical Help)

3.1

If you take this service, we will provide you with either of the following services over the telephone for a one-off fee or technical support at your home in Greater London

(i) If you choose the 'Set-Up' option, we will advise you on any queries you have about the set up of your hardware, operating system(s) and application

If you take our Home Support Service, we will agree the scope of the services to be provided to you and the applicable fee at the time you place your order with us. The service we provide to you may include set up and configuration of your home computer(s), including:

(i) networking peripherals and equipment;

(ii) networking fully licensed original copies of software; and

(iii) networking fault diagnosis and rectification.

Our Home Support Service is currently only available to customers in selected post-codes within the London area by pre-booked appointment. For details of the applicable post-codes and our schedule of fees call us on 0845 095 1020. From time to time, we may agree to provide our Home Technical Support service to customers in post-codes outside our standard service area. If we agree to do this you may be required to pay an additional fee, which we will tell you when you make your appointment for a technician to visit your home.

3.2 Our services are only available to consumers who require technical support for home-related use. We will not supply either of our services for business-related purposes.

3.4 We will not be able to provide you with support on any of the following:

(i) File servers;

(ii) File server operating systems;

(iii) Domain & active directory based networks;

(iv) Virtual private network (VPN) & wide area networks;


4. Your Responsibilities

4.1 If you take either of our services, we will provide the service to you subject to the following conditions:

4.2 You must have valid software licences for your operating system and all applications on your computer(s). You must supply details of the relevant licence keys if we ask you for them.

4.3 You must back up your Software and Data. You agree that prior to contacting us to perform diagnostic repairs or to provide other technical support on or in connection with your computer(s), and either on-site or remotely, it is your entire responsibility to protect your personal computer and to back-up all data, software, information and other files that are stored on any and all computer disks and drives you may have.

4.4 You agree to follow our reasonable instructions, including any security instructions. This may include installing any equipment of software that we advise and following any other reasonable instructions that we may give you about the service we provide.

4.5 If you are unable to comply with any of the above requirements, we may be unable to or will be entitled to decline our service to you. We may also charge you a cancellation fee.

5. Our responsibility to you

5.1 We may not be able to advise on all issues or to repair or solve all problems that you ask us to, but to the extent that we cannot advise on an issue or repair or solve a problem that we agreed was included in the scope of our services then we will refund any applicable fee paid by you to us. Separately we may not be able to fulfil any service requests that fall outside the agreed scope of our services, in which case no refund will be payable.

5.2 We will not be responsible to you:

(i) For any inherent failures in or caused by the supported applications and operating systems or third party products supplied by us;

(ii) For the repair or replacement of any equipment that is faulty (as reasonably diagnosed by us during the provision of our service to you);

(iii) For any failure by you to follow our reasonable advice, recommendations or instructions;

(iv) If either we, including without limitation any of our technicians, agents, contractors or third party service providers are impaired or stopped from providing the service by you for any reason whatsoever or are otherwise unable to provide a service to you as a result of any event that is outside our reasonable control;

(v) For any damage to your hardware or equipment.

5.3 Our technician will use reasonable endeavours to keep any appointment you make with us for our Home Service, but we cannot guarantee that the technician will arrive on time in each case. If a technician is delayed, he or she will try to contact you a reasonable time in advance to let you know of any expected delay. From time to time, factors outside our control may also require that we re-schedule an appointment. If we have to do this, we will try to re-schedule another appointment as soon as reasonably possible. We will not be responsible to you for any delay in keeping appointments or if we have to re-schedule an appointment due to circumstances beyond our reasonable control.

5.4 Nothing in these terms of service shall exclude or limit our liability for death or personal injury caused by our negligence or that of our technicians or agents, or for any liability arising under Part I of the Consumer Protection Act 1987.

5.5 We shall not be liable to you for:

(i) any loss that is not reasonably foreseeable;

(ii) any loss calculated by reference to profits, income, or business (or loss of such profits, income, or business);

(iii) any loss of goodwill;

(iv) any loss or corruption of data; or

(v) any losses you may suffer arising from your use of (or failure to use) any anti-virus software.

5.6 We do not accept liability for the acts or omissions of any providers of telecommunication services.

5.7 Our aggregate liability, whether in contract or for negligence or breach of statutory duty or otherwise, to you for any loss or damage of whatsoever nature and howsoever caused shall be limited to and in no circumstances shall exceed the cost of the individual session, consultancy or technical help.

5.8 The limitations of liability set out in this clause 5, are in addition to any other provisions limiting our liability set out elsewhere in these terms of service.

5.9 Nothing in these terms of service shall impose any liability on us in respect of non-performance of a service where the performance claimed is outside these terms of service or where such non-performance is directly due to your acts, omissions, negligence or default.

5.10 We shall have no responsibility to you for any goods, services, information, software or other materials that you use or obtain when using your personal computer whether offline or online for accessing the internet (including e-mail).

6. What happens if you want to cancel, re-schedule or if you miss an appointment

6.1 Cancelling or Re-Scheduling an Appointment. You may cancel or re-schedule a Home Service appointment at any time up to 24 hours before the appointment time without charge. If you wish to cancel or re-schedule after this, we may charge you a cancellation or re-scheduling fee.

6.2 Missed Appointments. If you are unable to keep a Home Service appointment you have made with us, we may charge you for a missed appointment.

7. Privacy Policy

We are committed to safeguarding the privacy of our website visitors; this policy sets out how we will treat your personal information.
